N.Y. legislation gives government unlimited detainment power over citizens for whatever they deem a “health risk”3 minute read

The stripping of our rights continue with the New York State Assembly just passing bill A416. A bill that literally gives the power to detain anyone that posses what they deem a “health risk” for any amount of time they see fit.

Daniel Horowitz tweeted some of the startling language that is included in what some are calling a “concentration camp bill.”

Daniel Horowitz on Twitter: “”UPON DETERMINING BY CLEAR AND CONVINCING EVIDENCE THAT THE HEALTH OF OTHERS IS OR MAY BE ENDANGERED BY A CASE, … IN THE OPINION OF THE GOVERNOR.. MAY ORDER THE REMOVAL AND/OR DETENTION OF SUCH A PERSON OR OF A GROUP OF SUCH PERSONS BY ISSUING A SINGLE ORDER” / Twitter”

” OR PREMISES DESIGNATED BY THE GOVERNOR OR HIS OR HER DELEGEE AND COMPLYING WITH SUBDIVISION FIVE OF THIS SECTION.”

That is just the tip of the iceberg. This bill is filled with language that is clearly an abuse of power.

The bill authorizes the detainment of an individual or group that in the opinion of the Governor or their delegate is a public health risk for up to 60 days without a court order.

“IN NO EVENT SHALL ANY PERSON BE DETAINED FOR MORE THAN SIXTY DAYS WITHOUT A COURT ORDER AUTHORIZING SUCH DETENTION.”

The verbiage used in part of this bill allows the state to determine where the person or group will be held. Furthermore, it allows the state to hold the individual or group against there will.

“A PERSON WHO IS DETAINED IN A MEDICAL FACILITY, OR OTHER APPROPRIATE FACILITY OR PREMISES, SHALL NOT CONDUCT HIMSELF OR HERSELF IN A DISORDERLY MANNER, AND SHALL NOT LEAVE OR ATTEMPT TO LEAVE SUCH FACILITY OR PREMISES UNTIL HE OR SHE IS DISCHARGED PURSUANT TO THIS SECTION.”
